Welcome to Smart Allowance (Mesada Inteligente)! These Terms of Use govern access to and use of our platform. By creating an account and using our services, you fully agree to these terms.

IMPORTANT: Read this document carefully before using the platform. If you do not agree with any part of these terms, do not use our services.

1. Definitions

For the purposes of these Terms of Use:

• Platform: The Smart Allowance service, accessible via the web and mobile devices.
• User or You: An individual over 18 years of age who creates and maintains an account on the platform.
• Parent/Guardian: A father, mother, or legal guardian who registers children and adolescents on the platform.
• Child or Adolescent: A person under 18 years of age registered by their legal guardian.
• Services: All features offered by the platform, including task creation, gamification, points tracking, and rewards.
• Content: Text, images, photos, data, and other information entered by users on the platform.

2. About Smart Allowance

Smart Allowance is a digital platform offered under the Software as a Service (SaaS) model, designed for organizing family chores, gamification, points tracking, rewards, and allowance management, with an educational focus.

The platform allows parents and guardians to:

• Create custom tasks for their children.
• Track progress and approve completed tasks.
• Award points and manage rewards.
• Use gamification to encourage responsibility and financial education.

IMPORTANT: Smart Allowance is an educational tool and does not offer financial services or handle real money, nor does it replace professional advice from educators, psychologists, or financial advisors.

3. Acceptance of the Terms

By creating an account, you represent that:

• You are over 18 years of age and have the legal capacity to enter into contracts.
• You have read, understood, and fully agree to these Terms of Use.
• You have read and agree to our Privacy Policy.
• You take responsibility for the use of the platform and for the data you register.

4. Registration and Account

4.1. Account Creation

To use the platform, you must create an account by providing true, accurate, and up-to-date information, including your name, email address, and password.

4.2. Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials (email and password).
• All activity carried out through your account.
• Immediately notifying Smart Allowance of any unauthorized use or security breach.

4.3. Registration of Children and Adolescents

Only legal guardians may register children and adolescents on the platform. Registration requires specific and prominent consent as required by the Brazilian General Data Protection Law (LGPD).

5. Appropriate Use of the Platform

5.1. User Obligations

By using the platform, you agree to:

• Provide true information and keep it up to date.
• Use the platform exclusively for lawful purposes and in accordance with these Terms.
• Respect Smart Allowance's intellectual property rights.
• Not share login credentials with third parties.
• Immediately report any technical or security issues.

5.2. Prohibited Use

The following is strictly prohibited:

• Using the platform for illegal or unauthorized activities.
• Violating intellectual property rights, privacy rights, or any other rights of third parties.
• Attempting to access restricted areas of the platform or related systems without authorization.
• Sending viruses, malware, or any malicious code.
• Reverse engineering, decompiling, or disassembling any part of the platform.
• Using the platform to harass, threaten, or harm other users.
• Publishing content that is offensive, discriminatory, pornographic, or that violates children's rights.
• Using bots, scripts, or automated tools to access the platform.
• Copying, reproducing, or distributing platform content without authorization.

6. Subscription and Payment

6.1. Free Trial Period

We offer a 40-day free trial period for new users. During this period, you have full access to all platform features.

6.2. Premium Plan

After the trial period ends, your subscription will automatically convert to the premium plan, with automatic monthly renewal at R$ 14,90 (BRL) per month.

6.3. Payment Processing

Payments are processed through certified third-party payment processors (PayPal or Asaas). Smart Allowance does not store full credit card details.

6.4. Automatic Renewal

Your subscription will renew automatically each month, and the amount will be charged to the credit card on file, unless you cancel before the next billing cycle.

6.5. Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to the services until that date.

IMPORTANT: Cancellations made during the free trial period prevent any future charges.

6.6. Refunds

We do not offer refunds for subscriptions already paid, except where required by law (the 7-day right of withdrawal under the Brazilian Consumer Protection Code — Código de Defesa do Consumidor).

7. Intellectual Property

All platform content, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of Smart Allowance or its licensors and is protected by Brazilian and international copyright and intellectual property laws.

7.1. License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the platform for personal, non-commercial purposes, subject to these Terms of Use.

7.2. User Content

You retain ownership of the content you upload to the platform (evidence photos, notes, etc.). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of providing the services.

8. Changes to the Platform

Smart Allowance may, at any time, make improvements, updates, fixes, and adjustments to the Platform, including modifying, updating, adding, or discontinuing features, in order to enhance the User experience and/or meet technical, operational, legal, or security requirements.

• We may perform scheduled or emergency technical maintenance, which may cause temporary unavailability.
• New features or services may be added and rolled out progressively.
• Features may be changed or discontinued, provided such changes do not disproportionately harm the User or defeat the essential purpose of the Platform.
• Changes to prices and commercial terms will be communicated at least 30 (thirty) days in advance.

Whenever relevant changes materially affect the use of the Platform, we will make reasonable efforts to inform the User in advance, via the website, the registered email address, or an in-platform notice.

9. Privacy and Data Protection

The processing of personal data is governed by our Privacy Policy, which is an integral part of these Terms of Use.
